Estate Planning
Why do I need a will?
A will allows you to have full control over who inherits from you, make specific gifts to individuals, and if you’re a parent of minor children, it allows you to appoint a guardian. It also simplifies procedures and processes for your family members and friends when you have passed away.
What other estate planning documents do I need?
We typically recommend general (financial) power of attorney, medical power of attorney, and a living will/advanced directive. These documents allow you to lay-out your wishes and to appoint people you trust to act on your behalf.
What happens if I die without a will?
If you die without a will, your property passes pursuant to Colorado law, rather than your specific wishes. It also can complicate matters and be more difficult for your living relatives and friends.
Can I name who I want to take care of my children in my will?
Yes, this often is one of the main concerns that our clients with minor children have when they meet with us to draft their wills. We understand that and prioritize this for our clients who want to include this.
Probate
What happens if I am named as a personal representative/executor of an estate?
That means that you will have the legal authority/responsibility to accomplish the stated desires in the deceased person’s will. We are here to assist you with all of your needs and to walk you through Colorado Probate.
How long does probate take?
It depends on the complexity of the assets of the estate. Typically most cases are completed within 6 – 18 months.
